The appeals court ruling in this case was not a ruling on the merits
of the case. By dismissing the plaintiff's appeal, the court did
uphold a lower court's ruling that web sites are not covered by the
ADA, but it did so solely on procedural grounds. Basically, the
court concluded that the case presented to the appeals court was
different from the case originally presented in the lower court. So
the court felt compelled to dismiss it, while acknowledging the
importance of the issue. I believe we can expect other cases along
this line that are more carefully framed to address the issues, and
when those legal processes are done, we will have a better idea what
the law means. Of course, Congress might decide to amend (clarify)
the law so that the courts don't have to.
